AI transparency rules are already in force in the European Union. What does that mean for businesses?

On July 20, the European Commission published guidelines explaining the transparency obligations established under Article 50 of the EU AI Act.

These rules started applying on August 2, 2026 and address several situations businesses need to understand — from informing people when they are interacting with AI to marking certain AI-generated content, disclosing deepfakes and providing transparency around certain biometric and emotion-recognition systems.

There is also a significant compliance consideration: fines can reach €15 million or 3% of worldwide annual turnover, subject to proportionality for SMEs and small mid-cap companies.

A limited transition applies until December 2, 2026 to certain marking and detection requirements for generative AI systems already placed on the market before August 2.

For companies operating internationally, this is a reminder that AI adoption increasingly comes with transparency and governance responsibilities.
