When dealing with ICE agents, always stay calm, remain silent, and do not open your door unless they produce a warrant signed by a judge. You have the right to refuse a search, ask if you are free to go, and demand to speak with an attorney. Never lie, use fake documents, or run.
Remain Silent: You have the right to remain silent. You do not have to answer questions about your birthplace or immigration status.
Do Not Open the Door: Keep the door closed. Ask the agent to pass a warrant under the door or hold it up to a window to verify it has a judge’s signature (a warrant signed by an ICE supervisor is not sufficient).
Verify Warrant/Identity: Ask for the officer’s name and credentials.
Do Not Consent to Search: If they enter without a proper warrant, clearly state: “I do not consent to your entry or to your search of these premises. I am exercising my right to remain silent. I wish to speak with a lawyer”.
If Detained: Do not resist, but say, “I am going to remain silent and I want to speak to a lawyer”. Do not sign any documents before speaking with an attorney.
Document the Interaction: Record the names, badge numbers, and actions of the agents, and if possible, have witnesses.
