City of Gold Coast has told the Planning and Environment Court that it will no longer seek refusal of the Nucrush Oxenford Quarry expansion, Although I did not support this position and was one of four councillors to vote against it, it's noted that Naomi Fowler, Division 2, Gold Coast as the representative for the area was unable to participate due to legal advice that the proximity of her home presented a material personal interest.
Council will now focus on securing the strongest possible conditions if the Court approves the application. The final decision as to the conditions that will be imposed rests with the Court.
576 submissions were made on this application and those of us whose communities are affected fought hard to see Council’s 2021 refusal upheld. The city engaged more than 16 expert witnesses, specialist planning lawyers and experienced barristers to test the proposal thoroughly. Although the recommendation was ultimately to move to approval with Conditions, the scrutiny led to real improvements in the Conditions Council hopes will be applied.
The Court gave orders this morning that the hearing for Conditions is set down from 16-20 November 2026.
