TIMBER GATES BY SID HILL
TERMS AND CONDITIONS OF SALE AND INSTALLATION
Business: Timber Gates By Sid Hill
Telephone: 07852 828294
1. General
These Terms and Conditions apply to all quotations, orders, supply and installation of timber gates and associated products provided by Timber Gates By Sid Hill (“the Contractor”).
By accepting a quotation or instructing the Contractor to proceed with an order, the customer agrees to these Terms and Conditions.
2. Quotations and Orders
All quotations are based on the measurements, specifications and requirements discussed with the customer.
Any changes to the agreed design, measurements, materials or installation requirements may result in additional charges. Any additional costs will be discussed with the customer before the extra work is undertaken.
Quotations may be subject to revision if the scope of work changes or unforeseen site conditions affect the work required.
3. Payment Terms
No deposit is required.
Full payment for the gates and any agreed installation work is due on the day the gates are fitted and installed.
The customer is responsible for ensuring payment is made in full on the installation day unless an alternative arrangement has been expressly agreed in writing beforehand.
Where payment is not made when due, the Contractor reserves the right to pursue recovery of the outstanding amount in accordance with applicable law.
4. Natural Characteristics of Timber
Timber is a natural material and will naturally respond to changes in weather, temperature and moisture levels.
The customer acknowledges that timber may develop characteristics including:
Natural splits and cracks.
Minor surface checking as the timber dries.
Changes in colour and appearance over time.
Movement, shrinkage or expansion.
Some warping, twisting or seasonal movement.
Such characteristics are common to natural timber and do not automatically indicate a manufacturing defect or faulty installation.
The Contractor will take reasonable care in selecting and constructing the gates. However, natural timber movement cannot be entirely prevented or guaranteed against.
Nothing in this section removes the customer's statutory rights where the goods or workmanship fail to meet the requirements of applicable law.
5. Splits in Timber and Splits Where Timber Meets Posts
Timber can develop splits as it dries or responds to changing weather conditions. Splitting may occur in gate components, joints or areas where timber meets or is fixed to posts.
The Contractor cannot guarantee that timber will remain completely free from splits throughout its lifetime.
Where a split develops as a result of the natural characteristics of the timber, this will be assessed in light of its location, severity and effect on the gate's structural integrity and function.
Where damage or a split results from defective materials, faulty workmanship or another matter for which the Contractor is legally responsible, the customer's applicable statutory rights will remain unaffected.
6. Warping and Movement of Gates
Timber gates may experience some movement or warping due to changes in moisture, temperature and weather exposure.
The degree of movement can be influenced by the location of the gates, exposure to direct sunlight, rainfall, prevailing winds, ground conditions and the way the timber is maintained.
The Contractor cannot guarantee that timber gates will remain completely straight or retain precisely the same dimensions indefinitely.
However, this does not exclude responsibility for gates that are defective or installation work that has not been carried out with reasonable care and skill.
7. Installation and Site Conditions
The customer is responsible for providing accurate information about the installation location and disclosing any known access restrictions, underground services, boundary issues or other site conditions that could affect the work.
Installation is subject to the suitability and condition of existing posts, walls, pillars, hinges, fixings and surrounding ground.
Where existing structures or site conditions are unsuitable, additional work may be required. Any additional charges will be discussed and agreed with the customer before the extra work is undertaken.
The Contractor will carry out installation work with reasonable care and skill.
8. Gate Adjustments
The first adjustment to gates installed by Timber Gates By Sid Hill will be provided free of charge.
This initial adjustment is intended to address ordinary settling or minor alignment issues following installation.
Any subsequent adjustments, call-outs or remedial visits may be chargeable. The cost will be discussed with the customer before chargeable work is carried out.
The free initial adjustment does not cover damage caused by misuse, accidental impact, unauthorised alterations, unsuitable existing structures or a lack of reasonable maintenance.
This provision does not limit the customer's statutory rights where an adjustment is required to remedy defective goods or installation work for which the Contractor is responsible.
9. Painting and Finishes
Where painting or a painted finish is provided on the gates, the Contractor does not charge a separate fee for this painting service.
Timber is a natural material and paint finishes may be affected by weather exposure, moisture, timber movement, natural resin, surface checking and general wear.
The customer is responsible for routine maintenance and for rectifying paint or finish deterioration arising from normal weathering, timber movement or general wear after installation.
The Contractor does not provide an ongoing painting or repainting service unless expressly agreed.
However, this section does not exclude the Contractor's legal responsibilities where a problem is caused by defective workmanship, a failure to meet an expressly agreed specification or another matter covered by the customer's statutory rights.
10. Customer Responsibilities and Maintenance
The customer is responsible for taking reasonable care of the gates following installation.
This includes:
Keeping hinges, catches and other moving components in suitable working condition.
Checking fixings periodically.
Maintaining appropriate protective finishes where required.
Avoiding unnecessary impact, misuse or excessive force.
Taking reasonable steps to protect the gates from avoidable damage.
Failure to maintain the gates may affect their appearance, movement and service life.
11. Damage and Exclusions
The Contractor will not be responsible for damage caused by misuse, accidental impact, third-party interference, unauthorised modifications or circumstances outside the Contractor's reasonable control, except where the law provides otherwise.
Any concern about the gates or installation should be reported to the Contractor promptly, with photographs where possible, to allow the issue to be assessed.
The Contractor will consider reported issues fairly and in accordance with applicable consumer law.
12. Cancellations and Changes
Customers should contact the Contractor as soon as possible if they wish to cancel or change an order.
The consequences of cancellation will depend on the stage of the order, whether bespoke manufacturing has begun, any materials already purchased and the terms agreed with the customer.
Any cancellation charges must be lawful and fair. Where the customer has statutory cancellation rights, including any applicable rights for distance or off-premises contracts, those rights will be respected.
13. Complaints and Disputes
If the customer has a concern about the gates, materials or installation, they should contact Timber Gates By Sid Hill directly so that the matter can be investigated.
The Contractor will aim to resolve complaints fairly and promptly.
Both parties should make reasonable efforts to resolve any disagreement before considering further action.
14. Statutory Rights
Nothing in these Terms and Conditions is intended to exclude or restrict any rights or remedies that the customer has under applicable law.
Where the customer is a consumer, their statutory rights relating to the quality and description of goods, fitness for purpose where applicable, and the proper performance of installation services remain unaffected.
15. Acceptance of Terms
Acceptance of a quotation, placement of an order or instruction to proceed with the agreed work constitutes acceptance of these Terms and Conditions, subject to any mandatory legal requirements and applicable consumer rights.
