Once The Code on Wages, 2019 becomes law,

1) any amount your company is paying as HRA above 30% of basic, it shall be considered as (basic ) wage!!*

2) any amount paid as OT above 90 hours in a quarter will also be considered as (basic) wage!*

3) HRA or conv allowance will not be counted as “wages” but something over and above that!!

SPLITTING OF MINIMUM WAGES INTO HRA - UPHELD BY THE SUPREME COURT

While revising the minimum rates of wages in the State of Haryana, the Government by its Notification No.3/42/83-3 Lab. dated 21.10.2015 had stated that "the minimum rates of wages notified herein above are basic rates of minimum wages which are not permitted to be segregated into components in the form of allowances by the employer". Being aggrieved, some employers and their associations filed the writ petitions which were not accepted by the Punjab & Haryana High Court. Even the Division Bench did not grant any relief. Special Leave Petition was filed by Faridabad Industries Association vs. State of Haryana.

This matter was relentlessly pursued by Sh Vishal Thakur, standing counsel for the association, over last four years across forums and courts, and we also thank him for his efforts and technical arguments which led to this victory for industry which is already under pressure of uncertainty on wage structures!

The Supreme Court in its judgment dated 29.4.2019 (SLP No. 4454/2019) has quashed the impugned notification. Hence the minimum wages can be split into house rent allowance (HRA).

Subscribers EPFO would not require to file employee provident fund (EPF) transfer claims on changing jobs from the next fiscal as the process would be made automated, according to a labour ministry official.

At present, the subscribers of the Employees Provident Fund Organisation (EPFO) are required to file transfer of EPF claims on changing jobs despite having universal account number (UAN). The EPFO gets about eight lakh EPF transfer claims every year.

"The EPFO is testing the automation of EPF transfer on changing jobs on pilot basis. The facility for all subscribers is expected to be launched any time next year," a senior labour ministry official said.

Minimun pension scheme for unorganised sector employees!

Employee share Will be given by state govt and second share given by center govt.

One has to only to pay one starting instalment of rs 50-200 and will received pension 3000/PM at the age of 60.

That means if you work and have a bank account, a pension is assured

I think this will address one point of moshy agenda to some extent

2019 provident fund judgement on allowance : Supreme Court

All industry has to pay minimum wage to all employees across! So first interpretation is that what has to paid to all employees accross industry has to be basic, thus minimum wage cannot be split.

Over and above, this minimum wage, if some employees avail a special opportunity and earn such special privilege can be left out, provided that it is not part of salary structure of majority of employees!!

Purpose of splitting HRA out of minimum wage also doesn’t make any justification, because it can be interpreted as avoidance to pay epf, same is for splitting conv allowance !

However, beyond 15000/- is voluntary, so even if basic is above 15000/- you may freeze epf payment on 15000/-,
