Sofa Club acts as an independent marketing and sales agent for sellers of pre-owned genuine leather couches. These Terms and Conditions govern the relationship between the Seller and Sofa Club / LeatherTech.
1. Agent Representation
Sofa Club acts solely as a marketing and sales agent on behalf of the Seller. Sofa Club does not purchase, own, guarantee, warrant, or otherwise assume ownership of any item listed for sale unless expressly agreed in writing. Ownership of the item remains with the Seller until it is sold, at which point Sofa Club facilitates the transfer of ownership to the Buyer.
2. Success-Based Commission
A 10% success fee is deducted from the final selling price upon successful sale of the item. This fee is payable only once the item has been sold and payment has been received from the buyer.
3. Refurbishment & Preparation Costs
By consigning the item to Sofa Club, the Seller authorises LeatherTech to perform reasonable cleaning, restoration, repairs, colour enhancement, panel replacements, foam replacements, recliner servicing, or other cosmetic improvements deemed necessary to maximise the saleability of the item. All costs incurred by LeatherTech will be itemized and provided to the Seller in advance. These costs will be deducted from the final sale proceeds.
4. Marketing Fees
Sofa Club may run paid advertising campaigns (e.g. Facebook Boosts) to promote the listing. A standard boost of R480 for 3 days is recommended. All marketing costs are deducted from the Seller’s payout upon successful sale.
5. Collection, Delivery & Risk
If Sofa Club or its logistics partner facilitates collection or delivery, the following standard fees apply (deducted from the Seller’s payout unless prepaid):

Delivery & Liability
Once the product leaves Sofa Club’s premises for delivery to the Buyer, Sofa Club, LeatherTech, and their logistics partners accept no responsibility or liability for any damages, loss, theft, or deterioration that may occur during transit, delivery, or thereafter. Risk passes to the Buyer upon the item leaving our premises.
6. Deposits
Any deposit paid by a prospective Buyer is non-refundable once the item has left Sofa Club’s premises for delivery.
7. Final Seller Payout
The final payout to the Seller is calculated as follows:
Sale Price – Refurbishment Costs – Marketing Fees – Success Fee – Logistics Fees (if applicable) = Payout
Sofa Club will transfer the final payout to the Seller’s nominated bank account within 7 working days of confirmed receipt of payment from the Buyer.
8. Unsold Inventory Policy
If the item remains unsold after 14 days, Sofa Club reserves the right to adjust the selling price and/or implement additional marketing measures.
9. Cancellation Policy
Should the Seller cancel the agreement after refurbishment, marketing, collection, storage, preparation, photography, or advertising has commenced, all costs incurred become immediately due and payable. In addition, Sofa Club shall be entitled to recover its anticipated commission (10% of the agreed estimated market value), as the Seller’s cancellation prevents Sofa Club from earning the agreed success fee. All outstanding amounts must be settled before the item is returned to the Seller.
10. Ownership & Risk
Until the item is sold, it remains the property of the Seller. Sofa Club and LeatherTech are not liable for any damage caused by force majeure or unforeseen events (including but not limited to fire, theft, flooding, or accidental damage) while the item is in our possession.
11. Seller Warranty
The Seller warrants that:
They are the lawful owner of the item;
The item is free from any finance agreements, liens, claims, or encumbrances;
They have full authority to sell the item;
All information provided regarding the item (including condition, history, and description) is true and accurate. The Seller indemnifies Sofa Club and LeatherTech against any claims, losses, or liabilities arising from any false, misleading, or inaccurate information supplied by the Seller.
12. Buyer Acceptance
All pre-owned furniture is sold voetstoots (as is), subject to reasonable inspection by the Buyer before purchase. Once delivery has been completed and accepted by the Buyer, the transaction shall be deemed final. Neither Sofa Club, LeatherTech, nor the Seller shall be liable for normal wear and tear, age-related characteristics, comfort preferences, colour variation, or subjective dissatisfaction expressed by the Buyer.
13. Storage Charges
Should the Seller fail to collect an item within 7 calendar days after written notice, Sofa Club reserves the right to charge storage fees of R75 per day per item. Storage fees shall be deducted from any sale proceeds or become payable before release of the item.
14. Abandoned Goods
Any item remaining uncollected for more than 60 days after written notice may be deemed abandoned. Sofa Club reserves the right to sell, dispose of, or otherwise realise value from the item to recover any outstanding refurbishment, storage, transportation, marketing, or administrative costs.
15. Marketing Consent
The Seller grants Sofa Club and LeatherTech irrevocable permission to photograph, advertise, market, and promote the item using any media platforms, including websites, social media, online marketplaces, printed material, and paid advertising channels.
16. No Guarantee of Sale
Sofa Club does not guarantee that any item will be sold within a specific period or at any particular price. Market demand, buyer preferences, condition, pricing, and economic conditions may affect the sale process.
17. Limitation of Liability
To the fullest extent permitted by law, Sofa Club, LeatherTech, their employees, contractors, agents, and logistics partners shall not be liable for any indirect, consequential, incidental, or economic loss arising from the storage, marketing, transportation, refurbishment, or sale of the item.
18. Dispute Resolution
Any disputes arising from this agreement shall first be resolved amicably between the parties. Where necessary, mediation will be pursued before any legal action is taken.
